9th Circuit Finds No Error In Use Of Insurer’s Damages Expert Testimony In Fraud Suit

Mealey's (December 22, 2015, 11:31 AM EST) -- SAN FRANCISCO — Finding no error in the allowance of a damages witness, the Ninth Circuit U.S. Court of Appeals on Dec. 17 upheld a jury award of compensatory damages on an insurer’s claims of fraud and racketeering under federal and state law against a doctor (Allstate Insurance Co., et al. v. Obteen N. Nassiri, D.C., No. 13-17030, 9th Cir.; 2015 U.S. App. LEXIS 21994).
