Florida Panel Reinstates Rule Changes Regulating Assisted Living Facilities

(January 31, 2020, 2:26 PM EST) -- TALLAHASSEE, Fla. — A Florida appellate panel on Jan. 29 reversed an administrative law judge’s (ALJ’s) ruling invalidating seven amendments to rules governing assisted living facilities (ALFs) in the state, finding that the Department of Elder Affairs (DOEA) did not exceed its rulemaking authority, that the changes were not arbitrary and capricious and that petitions challenging the amendments were not timely filed (Florida Department of Elder Affairs v.
