Insurance Payments For Paraplegic’s Settlement Disputed In 5th Circuit

(December 15, 2015, 4:09 PM EST) -- NEW ORLEANS — A Mississippi federal court failed to apply basic insurance principles in finding that a subcontractor’s insurer must pay part of a $5 million settlement for an inspector who was paralyzed in a fall from a ladder at a construction site, the insurer argues on appeal to the Fifth Circuit U.S. Court of Appeals (EMJ Corporation, et al. v. Hudson Specialty Insurance Co., No. 15-60254, 5th Cir.).
