Divided Oregon Appellate Court Affirms That ‘Children’ In Will Excludes Stepchildren

(November 19, 2019, 2:07 PM EST) -- SALEM, Ore. — The majority of the en banc Oregon Court of Appeals on Nov. 14 affirmed a probate court’s ruling that the term “my children” in a woman’s will did not refer to her stepchildren; however three judges dissented, agreeing with the stepchildren that the use of the term in the will is ambiguous (Sandra Garcia, et al v.
