Judge:  Insured Did Not Incur ‘Total Loss’ Under Louisiana’s Valued Policy Law

(November 5, 2019, 12:14 PM EST) -- BATON ROUGE, La. — A federal judge in Louisiana on Nov. 1 found that because insureds’  property was damaged by both flooding, which is a noncovered peril, and fire, which is a covered peril, there was no "total loss" under Louisiana’s Valued Policy Law and, therefore, they cannot recover the total amount of their homeowners insurance policy for their fire damage (Charles Nelson, et al. v.
