Arizona Appeals Court: Judge Erred When Allowing Board To Withhold Emails

(December 10, 2015, 7:30 AM EST) -- TUCSON, Ariz. — An Arizona appellate panel on Dec. 3 reversed in part a trial court judge’s decision affirming the Arizona Board of Regents’ decision to withhold from disclosure certain emails containing "prepublication critical analysis, unpublished data, analysis, research, results, drafts and commentary" on climate change written by two University of Arizona (UA) professors that were requested by an environmental education group, holding that the judge erred when finding that the board did not act arbitrarily or capriciously when refusing to produce the information (Energy & Environment Legal Institute v.
