State High Court Affirms Reversal Of Defective Fan Maker’s Summary Judgment Award

(October 28, 2019, 1:04 PM EDT) -- TOPEKA, Kan. — The Kansas Supreme Court on Oct. 25 affirmed an appeals panel’s decision finding that a military home builder could seek to recover property damages from fires caused by defective bathroom exhaust fans under the Kansas Products Liability Act (KPLA) because the claim is not barred by the economic loss doctrine and that the lower court should determine if the builder’s request for removal and replacement costs can be recovered under a claim for unjust enrichment (Corvias Military Living LLC v.
