ERISA Claims Survive Dismissal Motions In Allstate Contract Dispute
Mealey's (December 7, 2015, 12:02 PM EST) -- PHILADELPHIA — A Pennsylvania federal judge on Dec. 1 agreed to toss state law breach of contract and breach of fiduciary duties claims filed by insurance agents after they were forced to become independent contractors but ruled that the agents may proceed with their multiple claims filed under the Employee Retirement Income Security Act (Rodney Tabor, et al. v. Allstate Insurance Company, et al., No. 15-2602, E.D. Pa.; 2015 U.S. Dist. LEXIS 161372).
