Retiree’s Suit Dismissed; Claims Are Completely Preempted, Federal Judge Says
(December 7, 2015, 10:42 AM EST) -- GREEN BAY, Wis. — A suit alleging an error in administering a pension benefit plan is completely preempted by the Employee Retirement and Income Security Act, a Wisconsin federal judge said Nov. 19 in dismissing a retiree’s complaint (Jeffrey Arndt v. AON Hewitt Benefit Payment Services LLC, et al., No. 15-750. E.D. Wis.; 2015 U.S. Dist. LEXIS 156553).
