Wisconsin Appeals Court Affirms Indian Tribe Did Not Waive Sovereign Immunity

Mealey's (June 16, 2015, 4:16 PM EDT) -- WAUSAU, Wis. — In a per curiam opinion, a Wisconsin appeals court on March 10 affirmed that a restaurant owned by the Lac du Flambeau Band of Lake Superior Chippewa Indians did not waive its sovereign immunity from suit in state court and, therefore, a state court was correct in voiding its judgment awarding the plaintiff damages in his workers’ compensation case (Benjamin D.
