Federal Judge Dismisses FDCPA And Fraud Claims Against Wells Fargo
Mealey's (December 2, 2015, 2:16 PM EST) -- DETROIT — A Michigan federal judge on Dec. 1 granted a bank's motion to dismiss a claim for violation of the Fair Debt Collection Practices Act (FDCPA) and causes of action for fraud and quiet title, finding that there was no dispute as to who holds the note to a property that is scheduled for foreclosure (Robert Mayer v. Wells Fargo Bank, N.A., No. 15-12503, E.D. Mich.; 2015 U.S. Dist. LEXIS LEXIS 160660).
