Insurer: Insured’s Delayed Notice Eliminated Duty To Defend

(December 1, 2015, 1:09 PM EST) -- RICHMOND, Va. — An insurer has no duty to cover an insured’s defense costs when the insured fails to provide timely notice, St. Paul Mercury Insurance Co. argues in its Oct. 9 brief filed in the Fourth Circuit U.S. Court of Appeals, seeking affirmance of a Maryland federal court’s decision (St. Paul Mercury Insurance Company v. American Bank Holdings, Inc., No. 15-1559, 4th Cir.)....
