Insurers Have No Duty To Defend Condo Defect Suit, Illinois Judge Finds
Mealey's (November 17, 2015, 8:12 AM EST) -- CHICAGO — Four insurance companies have no duty to defend or indemnify the developers of a condominium building in a construction defect lawsuit, an Illinois trial judge ruled Nov. 9, finding that the underlying allegations include only faulty work damaging the building itself (Empire Fire and Marine Insurance Co. v. HLL Corp., et al., No. 05-7565, Ill. Cir., Cook Co.).
