Florida Appellate Court Overturns Judge’s Directed Verdict In Tobacco Suit

(November 12, 2015, 2:51 PM EST) -- LAKELAND, Fla. — A Florida appellate panel on Nov. 6 overturned a trial judge’s directed verdict for a tobacco company after finding that the plaintiff presented evidence that could have led the jury to conclude that a woman relied on the company’s alleged misleading advertising in her decision to smoke (Cindy Evers v. R J. Reynolds Tobacco Company, No. 2D13-2553, Fla. App., 2nd Dist.; 2015 Fla. App. LEXIS 16718).
