(May 30, 2019, 1:21 PM EDT) -- GALVESTON, Texas — A Texas federal judge on May 28 became the first to grant summary judgment in a lawsuit challenging the Clean Water Rule: Definition of "Waters of the United States," 80 Fed. Reg. 37,054, June 29, 2015, finding that the federal agencies that finalized the rule violated the Administrative Procedure Act (APA) and remanding the rule to the agencies to take comments on a definitional change (Texas, et al. v. United States Environmental Protection Agency, et al., No. 15-cv-162, S.D. Texas, Galveston Div., 2019 U.S. Dist. LEXIS 89113)....
