10th Circuit Clerk: Briefing In Fracking Land Access Case May Proceed

Mealey's (November 9, 2015, 9:36 AM EST) -- DENVER — The counsel to the clerk of the 10th Circuit U.S. Court of Appeals, which had ordered a hydraulic fracturing company to file additional documents regarding the finality of a district court ruling against it for improperly accessing land, on Oct. 23 ordered briefing on the merits to proceed. The district court previously delivered a verdict against the company for wrongly accessing land which the owners had not given it permission to use, but not all claims in the matter were decided, which left unresolved the issue of jurisdiction (Denbury Onshore LLC v.
