Split Appellate Panel Reverses Summary Judgment Ruling In Bad Faith Suit
Mealey's (November 5, 2015, 3:00 PM EST) -- YOUNGSTOWN, Ohio — A state trial court erred in granting summary judgment in favor of an insurer in an insurance bad faith lawsuit an Ohio appellate panel ruled Oct. 22, because a genuine issue of material fact exists as to whether Nationwide acted in bad faith in denying insureds’ bad faith claims (Latia N. Ballard, et al. v. Nationwide Insurance Co., No. 14-MA-85, Ohio App., 7th Dist., Mahoning Co.; 2015 Ohio App. LEXIS 4363).
