Judge Trims Some Contract Claims From Franchisee’s Suit Against 7-Eleven

Mealey's (March 4, 2019, 12:52 PM EST) -- PHILADELPHIA — A federal judge in Pennsylvania on Feb. 28 dismissed elements of a breach of contract claim brought by a franchisee and his business accusing 7-Eleven Inc. of engaging in a scheme dubbed “Operation Philadelphia” to force older franchisees out of franchise agreements by issuing bad faith inspection reports, ruling that the plaintiffs could not pursue breach of contract claims based on the franchisor’s failure to conduct fair and accurate merchandise audits and for charging the franchisees for not buying enough products (Anthony Chong, et al. v. 7-Eleven Inc., No. 18-1542, E.D. Pa., 2019 U.S. Dist. LEXIS 31962)....
