Kohl’s, Capital One Seek Class Decertification In Credit-Monitoring Suit

Mealey's (February 21, 2019, 1:14 PM EST) -- PHILADELPHIA — Kohl’s Department Stores Inc. and Capital One, National Association, on Feb. 18 moved to decertify the class of consumers suing them for allegedly profiting from a deficient credit-monitoring service; the motion was filed less than a week after a Pennsylvania federal judge denied the defendants’ motion to strike the lead plaintiff’s demand for a trial by jury (Jennifer Underwood, et al. v. Kohl’s Department Stores, Inc., et al., No. 15-730, E.D. Pa.)....
