9th Circuit Affirms Dismissal Of UCL, Fraud Claims Against Franchisor

Mealey's (January 15, 2019, 1:00 PM EST) -- PASADENA, Calif. — The Ninth Circuit U.S. Court of Appeals on Jan. 10 affirmed a district court’s decision granting summary judgment for a franchisor on a franchisee’s claims for violation of California’s unfair competition law (UCL), fraud and other causes of action, finding nothing showing that the gas station franchisor did not negotiate a sale in good faith or that its contract with him was intended to deceive the public (Mark Yi v. Circle K Stores Inc., No. 17-55971, 9th Cir., 2019 U.S. App. LEXIS 924)....
