6th Circuit OKs Second-Priority Claims Payments In Dow Corning Breast Implant Case

(December 18, 2018, 11:06 AM EST) -- CINCINNATI — The Sixth Circuit U.S. Court of Appeals on Dec. 13 said the federal district court overseeing the Dow Corning silicone breast implant bankruptcy settlement did not err when it determined that all first-priority settlement payments were “virtually guaranteed” and that the Dow Corning Settlement Facility can make second-priority payments from an estimated $100.4 million surplus (In Re:  Settlement Facility Dow Corning Trust, No. 18-1095, 6th Cir., 2018 U.S. App. LEXIS 35038)....
