Judge Refuses To Dismiss Nursing Facility’s Owners’ Suit Seeking Arbitration

Mealey's (December 14, 2018, 12:08 PM EST) -- ALBUQUERQUE, N.M. — A federal judge in New Mexico on Dec. 11 refused to dismiss an action filed by two owners of a skilled nursing facility seeking to compel arbitration of a wrongful death suit, finding that they are real parties in interest to an arbitration agreement between the woman who died and the facility, that the facility is not an indispensable party to the action and that the court has jurisdiction over the suit (Jerry Williamson, et al. v.
