West Virginia Asks Court To Vacate Stay In Case Challenging ACA Implementation

Mealey's (June 16, 2015, 9:55 AM EDT) -- WASHINGTON, D.C. — West Virginia on April 8 urged a federal court in the District of Columbia to lift a stay on summary judgment proceedings in its case challenging the implementation of the Patient Protection and Affordable Care Act (ACA). In response, the federal government argues that West Virginia had not surpassed the high bar for ignoring the law of the case (State of West Virginia ex rel. Patrick Morrisey v. United States Department of Health and Human Services, No. 14-1287, D. D.C.).
