Hospital Authority: Public Disclosure Bar Doesn’t Require ‘Outsider’ Disclosure

Mealey's (June 16, 2015, 9:43 AM EDT) -- CINCINNATI — A hospital authority on March 11 told the Sixth Circuit U.S. Court of Appeals that a panel wrote an “outsider” requirement into the public disclosure requirements of the False Claims Act and that Medicare-billing fraud disclosed through investigations and audits bars a man’s qui tam action (United States of America, et al., Robert Whipple v. Chattanooga-Hamilton County Hospital Authority, dba Erlanger Medical Center, dba Erlanger Health System, No. 13-6645, 6th Cir.).
