Plan, Amici Tell High Court That Enforcement Of Lien Constitutes Equitable Relief

(October 13, 2015, 10:33 AM EDT) -- WASHINGTON, D.C. — Trustees of a welfare benefit plan and several amici curiae have filed briefs urging the U.S. Supreme Court to rule that the plan may recover an alleged overpayment from a beneficiary as “equitable relief” under Employee Retirement Income Security Act Section 502(a)(3) after an equitable lien by agreement attached, even if the beneficiary spent the funds subject to the lien (Robert Montanile v.
