California Federal Judge Narrows False Labeling Claims Against P&G

Mealey's (October 29, 2018, 1:00 PM EDT) -- SACRAMENTO, Calif. — Two consumers are barred from continuing with proposed class claims alleging false labeling of The Procter & Gamble Co.’s (P&G) Herbal Essences Wild Naturals line based on claims on the company’s website and a negligent misrepresentation claim under New York law, but may proceed with their remaining claims that the products are falsely marketed as all natural, a California federal judge ruled Oct. 24, granting in part P&G’s motion to dismiss (Tom Takano, et al. v. The Procter & Gamble Company, No. 17-385, E.D. Calif., 2018 U.S. Dist. LEXIS 182777)....
