Amicus Brief On Petition For Rehearing Ruling Should Be Permitted, Groups Say

(October 25, 2018, 12:17 PM EDT) -- SAN FRANCISCO — A group of agricultural companies on Oct. 18 filed a supplemental brief in the Ninth Circuit U.S. Court of Appeals, arguing that they should be granted leave to file an amicus curiae brief regarding the Environmental Protection Agency’s petition for rehearing en banc of a Ninth Circuit split decision that found that there was no justification for the agency’s decision to maintain a tolerance for the chemical chlorpyrifos in the face of scientific evidence that its residue on food causes neurodevelopmental damage to children. The divided panel also it ordered the agency to “revoke all tolerances and cancel all registrations” for chlorpyrifos (League of United Latin American Citizens, et al. v.
