Federal Circuit: Patent Board Erred In Rejecting Design Patent Application

Mealey's (August 30, 2018, 6:55 PM EDT) -- WASHINGTON, D.C. — In an Aug. 20 holding, the Federal Circuit U.S. Court of Appeals found that the Patent Trial and Appeal Board erred in adopting an examiner’s findings that an application for a patent covering the design of an athletic shoe bottom is not sufficiently enabled or definite (In re:  Ron Maatita, No. 17-2037, Fed. Cir., 2018 U.S. App. LEXIS 23188)....
