Judge Refuses To Dismiss Insurer’s Coverage Suit Arising From Aggravated Assault

Mealey's (August 30, 2018, 11:19 AM EDT) -- SALT LAKE CITY — A Utah federal judge on Aug. 28 denied an insured’s motion to dismiss an insurer’s lawsuit disputing coverage for an underlying lawsuit seeking more than $300,000 in damages related to an aggravated assault that purportedly rendered the underlying plaintiff disabled with a permanent traumatic brain injury (Owners Insurance Company v. Jacob Taylor Dockstader, No. 18-173, D. Utah, 2018 U.S. Dist. LEXIS 147286)....
