Boat Owner Not Negligent While Passenger In Collision With Ferry, 9th Circuit Affirms

Mealey's (August 21, 2018, 10:32 AM EDT) -- SAN FRANCISCO — A boat owner who is a passenger on his own boat has no duty to keep a lookout unless he was jointly operating the boat or knows that the person operating the boat is likely to be careless, the Ninth Circuit U.S. Court of Appeals concluded Aug. 10 in a case of first impression.  It affirmed a lower court’s rulings on equitable indemnity and comparative negligence in a suit brought by the widow of a speedboat operator who was killed when the boat collided with a ferry (Mary Holzhauer, et al. v.
