Texas High Court Finds Spectator Can Claim Damages For Fall In Park
(October 2, 2015, 9:59 AM EDT) -- AUSTIN, Texas —– The Texas Supreme Court on Sept. 18 reversed an appeals court ruling in favor of a city, finding that a woman who fell and injured herself while watching a softball game was a spectator and that she was not partaking in recreation at the time of the accident (Louie Lawson, representative of the Estate of Carolyn Burns v. City of Diboll, Texas, No. 15-0037, Texas Sup.; 2015 Tex. LEXIS 876).
