Insured Failed To Provide Factual Support For Its Bad Faith Claims, Judge Rules

(September 29, 2015, 12:38 PM EDT) -- SOUTH BEND, Ind. — A federal judge in Indiana on Sept. 18 granted an insurer’s partial motion for summary judgment in an insurance breach of contract and bad faith lawsuit, ruling that an insured has failed to provide any factual support for its claim that the insurer acted in bad faith in its handling of claims related to an explosion at the insured’s recycling plant (G&S Metal Consultants Inc. v. Continental Casualty Co., No. 09-493, N.D. Ind.; 2015 U.S. Dist. LEXIS 125427).
