No Reasonable Excuse For Delay In Filing Motion For Relief, 3rd Circuit Says

(September 24, 2015, 2:04 PM EDT) -- PHILADELPHIA — A district court did not err in determining that a disability claimant’s motion for relief was untimely because there was no reasonable excuse for the 11-month delay in filing the motion and the delay would prejudice the defendants, the Third Circuit U.S. Court of Appeals said Sept. 21 (Judith Johnson v. Life Insurance Company of North America et al., No. 14-4161, 3rd Cir.; 2015 U.S. App. LEXIS 16728).
