Panel: Defendant Has No Duty To Refrain From Sending Texts To Driver In Fatal Crash

Mealey's (May 15, 2018, 2:31 PM EDT) -- ROCHESTER, N.Y. — A New York appeals panel on May 4 held that a person does not owe motorists a common-law duty to refrain from sending text messages to a person whom he or she knows, or reasonably should know, is operating a motor vehicle, affirming a lower court’s ruling arising from a two-vehicle fatal car accident (Carmen Vega v Sherry M. Crane, et al., No. 455 CA 17-01651, N.Y. Sup., App. Div., 4th Dept., 2018 N.Y. App. Div. LEXIS 3222).
