Insurer Failed To Prove Exposure Before Policy Effective Date Caused Leukemia

(March 1, 2018, 9:44 AM EST) -- PHILADELPHIA — A Pennsylvania federal judge on Feb. 27 determined that an underlying claimant’s exposure to benzene and other hydrocarbons does not fall outside of a pollution policy’s retroactive date because the insurer cannot prove that the claimant’s diagnosis of leukemia and ultimate death were caused by pre-retroactive-date exposures to the chemicals (Catlin Specialty Insurance Co. v.
