Judge: Fact Issues Exist On What Caused Collapse Of Insured’s Rain Tank

Mealey's (September 15, 2015, 12:24 PM EDT) -- RALEIGH, N.C. — Genuine issues of material fact exist as to what caused the collapse of a rain tank, a North Carolina federal judge ruled Sept. 14, denying summary judgment to an insurer and its insured in a coverage lawsuit (Sauer Inc. v. Lexington Insurance Agency Inc. d/b/a Lexington Insurance Co., No. 13-180, E.D. N.C.; 2015 U.S. Dist. LEXIS 122063).
