Businessman Cannot Claim Tribal Immunity, Ohio Federal Judge Says

Mealey's (September 11, 2015, 1:50 PM EDT) -- COLUMBUS, Ohio — An Ohio federal judge on Sept. 9 granted summary judgment to a city and city officials on a businessman’s claims that the city arbitrarily and capriciously interfered with his business operations and targeted him for harassment in violation of his constitutional rights because he is Native American after finding in part that the businessman cannot assert immunity based on his Indian heritage because he submitted no evidence to confirm that he is a member of a congressionally recognized Indian tribe or a legal representative of a tribe (Great Elk Dancer for his Elk Nation v.
