Evidence Does Not Support Breach Of Contract Claim, New York Justice Determines

(September 11, 2015, 10:06 AM EDT) -- NEW YORK — Because the evidence does not support an insured’s claim for total disability benefits, a New York County Supreme Court justice on Aug. 25 determined that the insured’s breach of contract claim could not stand and dismissed the insured’s complaint (Benjamin Weisman v. MONY Life Insurance Co., et al., No. 111957/2010, N.Y. Sup.; 2015 N.Y. Misc. LEXIS 3141).
