New York Probate Judge Grants, Denies Summary Judgment In Will Dispute

(January 19, 2018, 2:08 PM EST) -- NEW YORK — A New York judge on Jan. 10 granted in part and denied in part a trustee bank’s motion for summary judgment to dismiss the objections of a decedent’s disinherited son, finding that there was not enough evidence of diminished capacity, but that the question of whether the decedent’s wife and daughter exerted undue influence in the disposition of his estate should go to a jury (Will of Samuel Stein,  No. 2009-0382, N.Y.
