Judge: Contract Claims Fail In Fracking Sand Dispute; Foreclosure Claim Viable

(December 7, 2017, 8:18 AM EST) -- MADISON, Wis. — A federal judge in Wisconsin on Nov. 9 partially granted and partially denied a motion for summary judgment in a dispute over a contract for land on which the parties had initially planned to operate a facility for extracting sand used in hydraulic fracturing operations, concluding that the plaintiff’s breach of contract claims against the company that was supposed to obtain the land in question failed.  The judge held that the plaintiff’s strict foreclosure claim remained viable with certain conditions (Larchmont Holdings LLC v.
