Kentucky High Court Majority Says Alternative Dispute Agreement Is Unenforceable

(November 10, 2017, 2:57 PM EST) -- FRANKFORT, Ky. — An alternative dispute agreement signed by a wife who possessed a power of attorney status on behalf of her husband, who was admitted to a Kentucky nursing home facility, is not enforceable because the wife did not possess the authority to execute the agreement, the majority of the Kentucky Supreme Court said Nov. 2 after reconsidering the case on remand from the U.S. Supreme Court (Kindred Nursing Centers Limited Partnership d/b/a Winchester Centre for Health and Rehabilitation et al., v.
