Company Waived Its Right To Arbitrate Trade Secrets Claim, Judge Rules

(November 8, 2017, 11:01 AM EST) -- NASHVILLE, Tenn. — A plaintiff in a misappropriation of trade secrets lawsuit waived its right to compel arbitration on its misappropriation claim because it has already begun litigating the claim on the merits and because allowing the plaintiff to initiate arbitration proceedings at this point in the litigation would prejudice the defendants, a federal magistrate judge in Tennessee ruled Oct. 31  in denying the plaintiff’s motion (AFS Logistics LLC v. Christopher R. W. Cochran, et al., No. 16-3139, M.D. Tenn., 2017 U.S. Dist. LEXIS 181081)....
