2-1 Appeals Panel Reinstates Contractor’s Equitable Indemnity Claim

Mealey's (September 2, 2015, 1:43 PM EDT) -- COLUMBIA, S.C. — A 2-1 panel of the South Carolina Court of Appeals on Aug. 19 ruled that a trial court judge erred when entering summary judgment against a general contractor on its equitable indemnity claim against a subcontractor accused of defective stonework and failing to install flashing but affirmed the judge’s decision to dismiss the contractor’s claim for negligence (Stoneledge at Lake Keowee Owners’ Association Inc., et al. v.
