Pawnee Nation: Agency In Fracking Lease Dispute Failed To Provide Notice

Mealey's (October 31, 2017, 7:27 AM EDT) -- TULSA, Okla. — The Pawnee Nation of Oklahoma on Sept. 26 filed a brief in the 10th Circuit U.S. Court of Appeals, arguing that the U.S. Bureau of Indian Affairs (BIA) “not only failed to give notice of its lease approvals” regarding hydraulic fracturing operations on tribal land, but it also approved drilling permits on the leases and treated those approvals as final decisions only to change course and declare that the approvals were not final and therefore were subject to judicial review (Merrill Chance v. Ryan Zinke, et al., No. 16-549, N.D. Okla.)....
