7th Circuit Affirms Southwest Drink Voucher Settlement With Modifications

(September 1, 2015, 7:13 PM EDT) -- CHICAGO — The Seventh Circuit U.S. Court of Appeals on Aug. 20 affirmed a “coupon settlement” in a class complaint filed against Southwest Airlines Co. over its decision to stop honoring drink vouchers and the award of attorney fees based on the lodestar method; however, the appellate panel eliminated the lead plaintiff’s $15,000 incentive award and reduced the attorney fee award by $15,000 because those two parties failed to reveal that they are co-counsel in another pending class action in California, creating a potential conflict of interest (In Re: Southwest Airlines Voucher Litigation, Nos. 13-3264, 12-3462, 14-2591, 14-2602 and 14-2495, 7th Cir.; 2015 U.S. App. LEXIS 14601)....
