Judge: Pennsylvania, Federal Law Bar Municipality’s Fracking Ordinance

(October 24, 2017, 11:40 AM EDT) -- PITTSBURGH — A federal judge in Pennsylvania on Sept. 29 partially granted judgment on the pleadings in a dispute over a municipality’s right to prohibit underground injection control (UIC) wells used for disposing waste from hydraulic fracturing activities on grounds that the ordinance the local government enacted is preempted by state and federal law.  The judge, however, found that the fracking company opposing the ordinance did not have a property interest in the matter (Seneca Resources Corporation v. Highland Township, et al., No. 16-289, W.D. Pa.; 2017 U.S. Dist. LEXIS 162629)....
