Expert Testimony Creates Fact Issues In Strict Liability Case, Federal Judge Finds

(August 31, 2015, 1:24 PM EDT) -- PEORIA, Ill. — The expert testimony of a mechanical engineer and a biomechanical engineer creates genuine issues of material fact in a strict liability lawsuit against the manufacturer of a rocket cart for Wal-Mart Stores Inc., an Illinois federal judge ruled Aug. 26, denying summary judgment to the manufacturer (William Jones v. National Cart Co. Inc. and National Cart LLC v. Wal-Mart Stores Inc., No. 12-1186, C.D. Ill.; 2015 U.S. Dist. LEXIS 112844).
