3rd Circuit Finds ACA Changes To Public Disclosure Bar Aren’t Retroactive

Mealey's (August 28, 2015, 1:48 PM EDT) -- PHILADELPHIA — Changes the Patient Protection and Affordable Care Act (ACA) wrought to the public disclosure bar of the False Claims Act (FCA) are not retroactive, a Third Circuit U.S. Court of Appeals panel held Aug. 26 (United States of America, ex rel. James Judd, M.D.,, et al. v. Quest Diagnostics Inc., No. 14-3156, 3rd Cir.; 2015 U.S. App. LEXIS 15084).
