Mealey's (September 20, 2017, 10:23 AM EDT) -- SAN JOSE, Calif. — A California federal judge on Sept. 15 held that a current trustee of an irrevocable trust has standing to bring a financial elder abuse claim against a life insurer because it is “clearly an interested party and is uniquely situated to seek redress” for $1.4 million in fraudulent loans made on a life insurance policy, denying the insurer’s motion for summary judgment (South Dakota Trust Company, Trustee of the Donna Wills 2014 Irrevocable Trust, et al. v. American General Life Insurance Co., No. 13-05860, N.D. Calif., 2017 U.S. Dist. LEXIS 150318)....
