California Appeals Court Orders Trial Court To Stay Construction Defects Suit

(August 27, 2015, 9:13 AM EDT) -- FRESNO, Calif. — A California appeals court on Aug. 26 granted a homebuilder’s petition for a writ of mandate to have a trial court reverse an order denying the builder’s request to stay a construction defects lawsuit until the completion of the statutory prelitigation procedure required by the Right to Repair Act, ruling that the home buyer’s decision to dismiss its claim under the act did not support the decision to deny the motion to stay (McMillin Albany LLC v.
